These Terms of Service (“Terms”) govern access to and use of Resurface — Retro Action Item Tracker & Accountability for Jira (the “App”), provided by Outpost Labs (“Outpost Labs”, “we”, “us”), and distributed through the Atlassian Marketplace.
By installing or using the App, the customer organization and its authorized users (“you”) agree to these Terms. If you do not agree, do not install or use the App.

Note on the Atlassian Marketplace. The App is obtained, licensed, and billed through the Atlassian Marketplace. Your use is also subject to the Atlassian Marketplace Terms of Use and any agreement between you and Atlassian. If there is a conflict between these Terms and Atlassian’s terms regarding purchasing, billing, or platform operation, Atlassian’s terms govern those matters.
Subject to these Terms and to a valid Marketplace subscription, Outpost Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on your authorized Atlassian site(s) for your internal business purposes.
You will not, and will not permit any third party to:
Your use of the App is also governed by our Privacy Policy (https://outpostlabs.dev/resurface/privacy). The App runs entirely on Atlassian Forge, stores only a limited accountability layer, and does not transfer your data outside Atlassian. You are responsible for the content your users enter into free-text fields (such as source references and definitions of done) and for your own compliance obligations as data controller.
The App runs on the Atlassian Forge platform; its availability depends on Atlassian’s services. We provide best-effort, asynchronous support by email at support@outpostlabs.dev and/or through the support channel listed on the Marketplace. We do not commit to a specific response time or uptime unless separately agreed in writing.
We may update, modify, or discontinue features of the App over time, including to maintain compatibility with Atlassian platform changes. We will not intentionally degrade core functionality of a paid tier without notice through the Marketplace listing or release notes.
The App, including its software, design, and documentation, is owned by Outpost Labs and its licensors and is protected by intellectual property laws. Except for the license in Section 1, no rights are granted to you. Feedback you provide may be used by us without restriction.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements. The App is a productivity aid and is not a system of record for legal, financial, or compliance purposes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTPOST LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID FOR THE APP THROUGH THE ATLASSIAN MARKETPLACE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You will defend and indemnify Outpost Labs against third-party claims arising from your unlawful use of the App or your breach of these Terms, to the extent permitted by applicable law.
These Terms apply while the App is installed. You may stop using the App at any time by uninstalling it. We may suspend or terminate the license if you materially breach these Terms or if required by Atlassian or by law. Sections that by their nature should survive (including Sections 7–10 and 13) survive termination.
These Terms are governed by the laws of Romania, without regard to conflict-of-laws rules, and the parties submit to the courts located there, unless a mandatory consumer-protection law of your residence provides otherwise.
These Terms, together with the Privacy Policy and any Atlassian terms referenced above, are the entire agreement regarding the App. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. We may update these Terms prospectively; continued use after an update constitutes acceptance.
